. unemployment hit rock bottom near the beginning of the -- under the bush administration. you can see this right here. and this of course the changing the color here is when president obama took over in january of '09. who is responsible for this turnaround? >> absolutely the president. and it would be a better turnaround if the republicans had allowed a bigger stimulus. we'd have many more jobs. >> you'd make the case we didn't spend enough on the economy? >> not only did we not spend enough, but we wasted 40% of it on tax cuts for small business, which is inherently savings and not stimulus. it was a real policy mistake. >> so considering where we are, and now 33 months of private sector job growth, is this historic? >> it's certainly we're going in the right direction, ed. we're not creating as many jobs as we need for the population growth, but it's astonishing we're recovering the way we are and if the republicans would stop creating the uncertainty, remember the uncertainty by not making a deal, we'd see the numbers improving very dramatically. >> well, let me ask you in terms of the stabi

in the war itself. it's a difficult challenge. >> we understand the obama administration is now considering arming the syrian rebels, something you've advocated for a long time. obviously in reaction to concerns the administration won't have any sway with the rebels should the assad regime fall. arwa damon has been inside syria for more than about a week now. she's been talking to rebels who say they're angry at the international community for its inaction and won't tolerate meddling now. do you think there's anything at this point the u.s., its allies can do to try to repair that relationship? >> i think we could establish a safe zone from which they could organize and operate. the other problem, as you know, is the dramatic infiltration over the last year or so of these jihadists, al qaeda jihadist extremists from all over the arab world. you name a country and they've come in from there. and unfortunately, some of the countries that are providing the weapons, those have gone directly to these extremists. rather than to the moderate forces. and without a place to organize, to set up a gov

's interesting that the obama administration is not defending the law with the justice department. is that significant? >> it's very significant. it's pretty unusual. it happens once in a while. obama's come out and said, we've looked at this. it's a legal issue that we've looked at and it is an unconstitutional statute so we're not going to defend it. could be a political thing, too. >> what does that mean for gay people if the defense of marriage act is struck down in this country? >> it just means that we're going to have availability of benefits on the federal level. we have them on the state level for those states that have same-sex marriage. but it's not going to make it illegal not to have same-sex marriage. it will be a start in the right direction for full rights for gay people. >> for self-esteem and for -- as gay people say, pride, it would also mean a lot as well? >> it's the first step. and i think it's the right decision. >> thank you, karen. very interesting. argued in front of the supreme court. good stuff. >>> next here on cnn -- >> an nba legend sits down to talk

on the obama administration if the economy doesn't recover. >> all right. many thanks, scott rasmussen, appreciate it very much. >> thanks. >>> with just 26 days until we fall off the tax and fiscal cliff, two dozen house republicans have apparently defected from the boehner plan and signed a bipartisan letter with democrats. people are now asking is there a fallback position for the gop? well, here now to tell us is house majority whip california republican kevin mccarthy, the number three man. mr. mccarthy, as always, thank you for coming back on the show. can i get your comment on this letter, two dozen republicans, they're talking about tax rate flexibility along with a bunch of democrats. what's your take, sir? >> well, remember what they're saying here. what they're saying is that they're going to put everything on to the table. what we've been talking about for so long is where the president has been awol, this is a spending issue that we have a real problem with. we agree that we'll provide revenue, but we do not want to hurt a pro growth economy here. so it's how you go about

. that is discrimination. >> mark seimone, the obama administration stopped trying or deafing the defense of marriage act awhile ago. a lot of people got their back up over that but they let that go. i want to ask you if you agree. is it the financial ramifications that make this a federal issue or is jimmy write and it's really a civil rights issue? >> i don't know if i'm the one to ask. i don't think i'm even for heterosexual marriage. [ laughter ] >> i'm with mark. >> there's an economic benefit to this. obviously catering halls, wedding photographers, caterers, even divorce lawyers can make a lot of money here. the reason i think there has to be some federal law of ruling here, a marriage license has to be portable. people are going to prove state to state. clearly there are gay couples that need all kinds of protections. hospital visitation rights, civil protections of all kinds. i don't know if you call it the same as marriage but i'm starting to move more in that direction. >> stay put. we've got more work to do. 24 days until our economy falls off the tax and fiscal cliff. just where do we stand
